Please find below the Galaxe Consulting "Terms of Service" which will form the basis of the contract between YOU (the client) and us (the service provider).
1) The Service The service gives you a range of Internet design, hosting and content maintenance services. The service is intended for people directly or indirectly involved in the arts as well as small businesses. Your offer letter will detail the services to which you have subscribed. You can add services from our portfolio at any time. 2) Start of Contract On the day web site and content maintenance service goes online, subject to your acceptance of our offer, and return a signed copy of the offer letter to us and/or payment. 3) Our commitment When we provide the service to you we promise to use reasonable skill and care. We will, with best endeavour, keep your content up to date subject to you providing us with the content to be updated against the dates agreed. 4) Getting started This contract does not include the provision of telecommunications services necessary to access the Internet. We will provide you with a dial up access number to get Internet connection and download your emails. If you already have an Internet Service Provider we will provide you with the setup details to access your email via that connection. If you wish we can set up email forwarding to an email account of your choice. 5) Your instructions We will only accept instructions regarding the service from you or someone appointed by you. 6) Making sure the service is secure a) We will issue you with usernames and passwords. These are essential for your secure use of the service so you must ensure that they are kept confidential, secure and are used in accordance with all relevant instructions. b) If we think there is likely to be a breach of security or misuse of the service we may: (a) change your password and then we will notify you that we have done this; and/or (b) suspend username and password access to the service c) If you think that any username or password has become known by someone not authorised to use it, or if any password is being or is likely to be used in an unauthorised way, you need to inform us immediately. d) If any of the information you give to us when you sign up for the service changes, including any changes to your payment details, you must inform us immediately. 7) What we or our service partners may have to do a) Our hosting partner may need to temporarily suspend the service for operational reasons (e.g. for repairs, planned maintenance or upgrades), but before we do we will give you as much notice as we can. Our hosting partner will apply best effort to restore the service as soon as possible after any suspension. b) We may have to alter code or access numbers or technical specification associated with the service for operational reasons, and where we need to tell you about this we will give you as much notice as we can. 8) Service Issues a) Although we attempt to provide you with the best possible service, we cannot guarantee that there never will be issues with the service. However, we will and aim to correct all reported issues as soon as we reasonably can. b) If there is a service issue you should contact us immediately. 9) Membership benefits / Recommend a Friend a) For every friend you recommend to Galaxe Consulting, you will get a referral bonus of £15 or to the equivalent in goods or services once your friend has signed up and paid for the service. b) We will enter your web site in Internet directories and such like, utilising a number of submission services on a best effort basis. We will also enter your web site in our own directory of client web sites, which, with best effort, will be publicised to various search engines and organizations. c) We will enhance our membership benefits as we develop and will advise you on new benefits as and when they become available. 10) Privacy and Data Protection Galaxe Consulting is absolutely committed to the privacy of its clients. However, we may want to make some of your details, available to other very carefully selected 3rd parties. This would happen in order for them to offer their goods and services to you so that you can take full advantage of Galaxe Consulting membership benefits. If you do not wish for this to happen, please notify us by email or fax. We will send you an acknowledgement of your request. Please take considerable care about with whom you will share your contact information on the Internet, as this may make you vulnerable to stalking, fraud etc. 11) Your Obligations a) You must pay any applicable charges for the service. b) You must take all reasonable precautions to ensure that no one (including you) uses the service: i) fraudulently or in connection with a criminal offence; ii) to send, knowingly receive, upload, download or use any material which is offensive, abusive, indecent, defamatory, obscene or menacing, or in breach of copyright, confidence, privacy or any other rights; iii) to cause annoyance, inconvenience or needless anxiety; to spam or to send or provide unsolicited advertising or promotional material or, knowingly to receive responses to any spam, unsolicited advertising or promotional material sent or provided by any third party; iv) in an unlawful manner, in contravention of any legislation, laws, licence or third party rights; v) We may make available to you software that enables you to use the service. You must not copy or modify this software (unless allowed by law). vi) When we provide you with the service it, and any associated software, is intended for your use only. Therefore, you must not re-sell, transfer, assign or sub-license the service (or any part of it) or the associated software to anyone else. 12) Your web site Although we will maintain the content of your web site, we will not censor it. You are responsible for the material that you or anyone appointed by you provides. Material on your web site'(s) must not, and the use of it must not, in any way be unlawful. In particular, you must ensure that all necessary licences and consents (including those from owners of copyrights, performing rights and any other relevant intellectual property rights) have been obtained. |
